January 25, (THEWILL) – The Supreme Court has dismissed the joint appeal filed by Prof. Sani Yahaya and the New Nigeria Peoples Party (NNPP), seeking to sack Kefas Agbu of the Peoples Democratic Party (PDP) as Governor of Taraba.
A five-member panel of justices of the apex court, in a judgment on Thursday, upheld the concurrent judgment of the Appeal Court and the Taraba State Governorship Election Petition Tribunal, which affirmed the victory of Agbu in the 2023 Gubernatorial election.
The Court of Appeal, Abuja, had on November 29, aligned with the September 30th judgment of the Governorship Elections Petition Tribunal that affirmed the election of Dr. Agbu Kefas as the Governor of Taraba.
In its judgment on Thursday, the apex court, in a ruling read by Justice Garba Lawal, ruled that the appellate court was right in dismissing the appeal on the grounds of incomplete records.
“You cannot put something on nothing and expect it to stand,” the judge said, adding that the NNPP’s appeal “stands dismissed.”
