November 29, (THEWILL) – The Court of Appeal, Abuja, on Tuesday, dismissed the joint appeal filed by Prof. Sani Yahaya and the New Nigeria People’s Party (NNPP), which prayed the court to sack Kefas Agbu of the Peoples Democratic Party (PDP) as Governor of Taraba.
In a unanimous judgment by a three-member panel of justices, delivered by Justice Peter Affen, the court held that Sani and his party were not consistent in their prayers against the March 18 governorship election.
”They cannot claim a certificate of return in an election they claimed was fraught with non-compliance and irregularities.
“Section 137 of the Electoral Act, 2022 has not abrogated the provisions of the Evidence Act. The appeal lacks merit and accordingly dismissed,” the court held.
Earlier, the Governorship Elections Petition Tribunal sitting in Jalingo had, on September 30, affirmed the election of Dr. Agbu Kefas as the Governor of Taraba.
The three-member panel led by Justice G. Sunmonu dismissed the joint petition filed by the NNPP and its candidate, Prof. Sani Yahaya for lacking in merit.
